GENERAL AGREEMENT BETWEEN CUSTOMER
AND ALLINCLUSIVE.CO INC.
By clicking “I ACCEPT”, you
agree to all the terms, conditions, and notices set forth herein, and
you agree to be bound by the Agreement. Allinclusive.co reserve the
right at any time, at our sole discretion, to change or otherwise modify the terms,
conditions, and policies can change at any time without further notice to its
customers. We recommend that you review our site regularly for any
changes to its content and material.
As a condition of your use of
this Website, you represent that (i) you are at least 18 years of
age; (ii) you possess the legal authority to create a binding legal obligation;
(iii) you will use this Website in accordance with this Agreement; (iv) you
will only use this Website to make legitimate reservations for you or for
another person for whom you are legally authorized to act; (v) you will inform
such other persons about the terms and conditions that apply to the
reservations you have made on their behalf, including all rules and
restrictions applicable thereto; (vi) all information supplied by you on this
Website is true, accurate, current and complete, and (vii) if you have
a Allinclusive.co account, you will safeguard your account
information and will supervise and be completely and
solely responsible for any use of your account by you and/or anyone
other than you. We retain the right at our sole discretion to deny access to
anyone to this Website and the services we offer, at any time and for any
reason, including, but not limited to, for your misrepresentation
and violation of this Agreement.
TERMS OF PAYMENT
You authorize Allinclusive.co to
book reservations for the total reservation price, which includes the room
rate, airfare and any additional products purchased and displayed on the
Website, plus tax recovery charges, and service fees. Unless other payment
arrangements are made at the time of your reservation, you agree that your
credit card will be charged by the Allinclusive.co for the total and full reservation
price, even if you do not use the reservation. Upon submitting your reservation
request you authorize Allinclusive.co to
facilitate your reservations on your behalf and on the behalf of
any additional members traveling with you within the same
reservation/booking confirmation, including making payment
arrangements with hotel suppliers, airline carriers and/or any suppliers,
vendors or third parties.
Allinclusive.co is not
responsible for accidental errors in pricing or system problems which result in
a booking and its subsequent confirmation. Allinclusive.co reserves the right
to cancel any booking, for any reason within (72) seventy two business hours by
refunding the full purchase price to the customer.
Allinclusive.co strongly
recommends trip insurance and is not responsible for events that might lead to
your trip discomfort, late arrival and/or cancellations. Such examples are, but
not limited to personal illness, death in family, natural disasters, act of
war, epidemic, and issues and difficulties that exist within the resort.
You agree to abide by the terms
and conditions of purchase imposed by any supplier with whom you elect to deal,
including, but not limited to, payment of all amounts when due and compliance
with the supplier's rules and restrictions regarding availability and use of
fares, products, or services. You acknowledge that some third-party providers
offering certain services and/or activities may require you to sign their liability
waiver prior to participating in the service and/or activity they offer. You
understand that any violation of any such supplier's rules and restrictions may
result in cancellation of your reservation(s), in your being denied access to
the applicable travel product or services, in your forfeiting any monies paid
for such reservation(s), and/or in our debiting your account for any costs we
incur as a result of such violation.
Allinclusive.co acknowledges your credit card right for a charge back in case
of a dispute. However, once you have stayed the duration of your vacation at
the resort of your purchase, you waive any and all charge back rights to that
transaction.
Airport Transfers: Allinclusive.co provides all our customers, who
book a vacation package (including air and hotel), a hotel/airport transfer
voucher. As a courtesy service, and upon booking a “land only” vacation
through Allinclusive.co, we can arrange, upon customers’ request and
information of customer’s itinerary, transfers from the closest airport
to the resort/hotel area. In the event that the customer does not notify
Allinclusive.co of its need of a transfer, a transfer is not provided and
Allinclusive.co is not responsible to issue you a hotel transfer voucher.
In the event that a customer fails to arrive to the airport at the appropriate
and scheduled time, Allinclusive.co shall not be responsible to issue
additional hotel transfer vouchers. No refund shall be provided by
Allinclusive.co in the event that customer fails to utilize the hotel transfer
voucher between the airport and hotel.Standard and customary gratuities
are included in the cost of your package; optional gratuities are the
responsibility of the customer.
CHANGES/CANCELLATION POLICY
Allinclusive.co can accommodate
you if you wish to extend your travel reservations or add travel companion,
subject to availability and price changes. However, reservations are
non-transferable. The following is our policy in
connection with changes or cancellations based to your reservations,
unless otherwise indicated at the time of your purchase.
Airline: Allinclusive.co offers
airline bookings as a courtesy to its customers and no agency relationship
is created between Allinclusive.co and the customer. As
a result, if you have purchased airfare through Allinclusive.co, we
are not responsible and do not regulate airline fees, which
differ between each airline carrier. Your airline tickets
are non-refundable and the airline carrier cancellation
fees are, at minimum, $150 per ticket as a penalty and
are subject to increase based on each particular airline’s rules and
regulations. In the event your flight is with multiple
airline carriers, the cancelation fee would apply for each
carrier. Airlines would issue you credit on the remainder good for (1) one
year from the issuing date; however it is subject to change based on the
particular airline rules and regulations. Please visit individual airline
website for its change and/or cancellation policy.
Hotel: Allinclusive.co can make
changes or cancellations to your reservations which include but are
not limited to, name changes, trip extensions, trip cancellation,
additions to the reservation. All such requests must be made in
writing directly to Allinclusive.co and are subject to
the following rates and conditions, agreed to by
customer, which are subject to change without further
notice; (a) Changes or cancellations on a minimum of 10
day written notice prior to the date of departure is subject to a fee
of $50 Per Person *; (b) No Changes or Cancellation are allowed
on less than 10 days before departure and NO REFUND IS PROVIDED;
or (c) No shows or early departures from the travel
destination is subject to 100% forfeiture of the amount paid for the initial
booking and NO REFUND IS PROVIDED.
In the event of changes the
customer will be charged the current rate of the amended booking,
which may be higher than the rate previously paid, in which case the
customer is responsible for the difference.
*No cancellations or changes
are allowed, regardless of time of notice, for travel during all major
holidays, including but not limited to Christmas, Thanksgivings, New Years,
President’s Day, Easter/Passover, and Labor Day. Cancellations on these dates
will result in full forfeiture of your payment for the original booking.
Insurance is not mandatory, but highly recommended
Allinclusive.co does not govern or regulate the insurance
portion of your vacation..
You are bound by the cancellation/change policy of Travel Guard®
PROMOTIONAL RESTRICTIONS
Discount codes must be entered at
the time of booking to be considered valid and are valid on a hotel-only
portion of the booking. Discount codes may not be combined. Only one
discount code can be entered at any one time and reservations are limited to
one discount code per booking. All discount code expiration dates listed
are EST.
Allinclusive.co, Inc. has the
right to cancel, or deny the use of a promotional code for any reason
whatsoever, without further explanation.
TAXES, FEES AND SURCHARGES
Your vacation includes all of the
US governmental taxes but does not include any mandated tourist fee, such as
each country’s visa fees and its own government surcharges. (For example,
Dominican Republic currently requires a $10 tourism card purchase upon
arrival).
Allinclusive.co, Inc. is not
responsible for any additional fees, taxes and surcharges that are imposed to
you by the airline carrier, including but not limited to baggage fees and seat
selection. These additional fees may vary by each airline carrier and
Allinclusive.co highly advises the client to contact the particular airline
carrier for such fees and its rules and regulations. Further,
Allinclusive.co strongly advises its customers to purchase trip insurance.
Allinclusive.co , under no circumstance, is
responsible for any issues, delays, cancellations and other problems that may
be experienced by the customer through and with an airline carrier.
LIABILITY DISCLAIMER
When purchasing a vacation
through Allinclusive.co, it is the customer’s responsibility to 1)
check that information provided is accurate and matches your travel
documentation/passport and 2) make certain your travel documentation
is current and valid for travel. For the most current travel
requirements to the destination of your choice, please visit: www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, www.treas.gov/ofac and www.customs.gov. You,
the customer, is solely responsible for the content of your submission when making
a reservation and booking and providing any other information or content to
Allinclusive.co, its affiliates and/or subsidiaries and/or its vendors and/or
suppliers. Allinclusive.co is not responsible for any
change/cancellation fees that result from customer’s failure to verify and
adhere to the above information.
The airline carriers,
hotels, and other suppliers providing travel or other services for
Allinclusive.co are independent contractors and not agents or employees of
Allinclusive.co or its affiliates. As
such, Allinclusive.co and/or its affiliates shall not be
responsible for any acts, errors, omissions, representations,
misrepresentations, warranties, breaches or negligence of any such
supplier or for any personal injuries, death, property damage, accident,
disruption of travel, change of itinerary, irregularity, loss or delay, damages
or expenses incurred, to you or your travel or group companions, resulting from
: (a) breach of contract or any intentional or careless actions or omissions on
part of such suppliers; (b) any defect in any means of transportation; (c)
terrorist activities, political or social unrest, labor problems, mechanical or
construction difficulties, monetary crises, diseases, local laws, climatic
conditions, abnormal conditions or developments; or (d) any other actions,
omissions, force majeure or any other conditions outside our
direct control. By embarking upon your travel you voluntarily assume all risks
involved with such travel, whether expected or unexpected. Your hereby warned
of such risks, and advised to obtain appropriate insurance coverage against
them, including but not limited to travel medical insurance, lost & damaged
baggage insurance, and/or trip cancellation insurance. Allinclusive.co
makes no representation that travel to any destination advertised or sold is
advisable or without risk.
PERSONAL AND NONCOMMERCIAL USE LIMITATION
This Web site is for your
personal and noncommercial use. The content and information
on this Web site (including, without limitation, price and travel services), as
well as the infrastructure used to provide such content and information, is
proprietary to Allinclusive.co, Inc. or its suppliers and providers.
While you may make limited copies of your travel itinerary (and related documents)
for travel or services purchased through this Web site, you agree not to
modify, copy, distribute, transmit, display, perform, reproduce, publish,
license, create derivative works from, transfer, or sell or re-sell any
information, software, products, or services obtained from this Web site.
INDEMNIFICATION
You agree to defend and
indemnify Allinclusive.co, Inc., its affiliates, and/or their respective
suppliers and any of their officers, directors, employees and agents from and
against any claims, causes of action, demands, recoveries, losses, damages,
fines, penalties or other costs or expenses of any kind or nature including but
not limited to reasonable legal and accounting fees, brought by you
or on your behalf in excess of the liability described above or by third
parties as a result of: (a) your breach of these Web Site Terms,
Conditions and Notices or the documents referenced herein; (b) your
violation of any law or the rights of a third party; or (c) your use of
this Web site.
